R e p l y .— T he fale of the other Have is valid; and the invalidity
.of fale with refpedt to on e does.not affedt the fale of the o th e r -, becaufe
the in v a lid ity , in this inftance, is w e a k , as there is a difference of
opinion regarding it amongft our dodtors; and alfo, becaufe it is
founded on a fufpicion of « fu r y , the effedt of which fufpicion
cannot extend beyond the fu b je E l of fufpicion,. namely, the firft
flave.
If a perfon purchafe oil, on this condition, that it be weighed
with the veflelin which it is. contained, and that a dedqdtion of fifty
r a t h fhall be made on account of the weight of the veffel,. fuch fale is
not valid; whereas, if the condition be, in g e n e r a l terms, that “ a
“ dedudtion fhall be made for the weight of the veffel,” it is valid;—
becaufe the fo rm e r condition is not eflential to the contrail, whereas
the la t te r is eflential.
If a perfon, having purchafed oil in a leathern bag, fhould carry
it away with him, and afterwards return a bag to the feller weighing
ten r a t ls , and the feller affert that “ this is not the bag he had car-
“ ried away with him, as that weighed onlyf i v e r a t l s ;” in this cafe
the averment of the purchafer is to be credited, whether the queftion
of difagreement be confidered as relating to the b a g being different,—
or to the confequent difference it creates with refpedt to the quantity
of oil; becaufe, if the difference be confidered as relating to the id en t
it y o f th e b a g of which the purchafer had taken poffeflion, -M s affer-
tion muft be, credited, fince the word of the pofl'effor is to be credited,
whether he be r e fp o n fib le for the article (as in the cafe of an u fu r p e r )
or merely a c o n fid e n t (as in the cafe of a t r u f ie e ; ) — or if, on the other
hand, the difference be confidered as relating to the q u a n tity o f o il,
this refolves itfelf into a difference with refpedt to the am o u n t o f th e
