concern"^« h°wever’ the W this inftance be an adult, the purchafer is: en-
whichhis a titled to fuch compenfation.— The reafon of this diftindtion is that, in
theTn&nt)'0 former inftance, the right of property, with, regard to the infant,
Mg Return takes P'ace immediately on the.cutting of the cloth, andprevious to
to the feller, its being fewn; and confequently,. as the, purchafer by this aft invefts

p«ifarion<for* M kee°mes the caufe of the detention of it from the feller previous to
a defea. its being fewn, and is therefore not entitled to the compenfation:_in
the latter inftance, on the contrary, the right of property with regard
to the adult does not take place upon the fewing, nor until he actually
take poffejfion of the garment;. and hence, as it is by the fewing-, and
not by the invejliture in the adult., that- the return, of the cloth to the
feller becomes impracticable, it follows that the purchafer, by making
, this inveftiture, does not detain the cloth from the feller, and confer
quently, that Ire is entitled to a compenfation

Analogy would fuggeft that in this laft cafe the purchafer is not
entitled to a compenfation, becaufe the obftacleto thereturn proceeds,
in this inftance, from the a& of the purchafer: the cafe, therefore,
