I T hE uûraî method however of calculating the Zakât upon large
herds of. cattle is, by dividing them into thirties or forties, impofmg
upon every thirty one T ’M ee ; or upon .every forty one Mifna.
It is to be obferved that buffaloes are included with kine in the
laws of Zdkat, thefe being alfo confidered as a fpecies o f black cattle.:
but yet, in-our country*, the buffalo is not regarded as of the black
cattle fpecies-; whence it is that if a perfon were to make a vow,
.faying, “ I will not eat of the flefh of black cattle,” and were afterwards
to eat buffalo beef, he would not be forfworn.
S E C T . III.
O f the Z A K a t o f Goats.
No Zakât is due upon fewer than forty goats ; and upon forty goats,
which feed for the greater part of the year, upon pafture, there is due,
at the expiration o f the year, a Zakât of one goat ; and this Zakât
fuffices for any number from forty to one hundred and twenty : and if
the number exceed one hundred and twenty, a Zakat of two goats.is
due from one hundred and twenty-one to two hundred: and if it exceed
tw o hundred, a Zakât of three goats is due from two hundred and one
to three hundred and ninety-nine: and i f it amount to fo u r hundred, the
Zakât is fou r goats; i and beyond four hundred the Zakât is one goat
for every hundred ; the prophet having thus ordained, and all the
doctors uniting in this opinion. It is alfo to be obferved, that the
fame rules of Zakât are applicable to fheep as to goats, the term
Ghanneru, in the tradition, equally implying both fpecies.
In the Zakât of goats or fheep, Sinnees are acceptablé payment, but
not Jutssuts. This is the Zâbir-Rawâyet. Sinnees are kids which
have entered on the fécond year ; and Juzzas are fuch as have not yet

Zakat may be paid with the Juzzas of fheep ; and there is one opinion
of Haneefa recorded to this effect; and the reafons are twofold ;
F irst, the prophet has faid, “ I ’he Zakdt upon them conffs o f Juzzas
“ and Sinnees — Secondly, facrifice is fulfilled by the immolation
of a Ju zza , and therefore Zakatvnzy be alfo difcharged by it. The
ground upon which the Zahir-Rawayet proceeds is alfo twofold ;
First, a faying of Alee, “ In Zakdt nothing is acceptable Jhort o f a Sin-
“ n e e — Secondly,, in the Zakdt of goats- it is incumbent to. give
thofe of a middling fize , and the Juzzas. of fheep are-not of that flandard,
being fmall; whence it is that the Juzzas o f goats alfo are not acceptable,
in Zak&t.. With refpeft to the firfl reafon urged by the two
difciples, it may be replied, that by the term Juzza,. as mentioned in
the tradition, is to be underflood the Juzzas of camels, that is, yearling
colts:-, and what they fay of facrifice. is no, rule, as. that of a Ju zza is .
approved,, (not by analogy,, but) from; the. exprefs words, o f the facred
text.
In. paying the Zakât of goats or fheep; males and females are equally
acceptable ; the term Shat, in the traditions, applying indifcriminately
to. both genders,...
but males and
