which is equivalent to an acknowledgment'; and an acknowledgement,
even in that cafe, is ufeful, as it induces refponfibility. According
to Aboo Yoofaf, on the contrary, an oath is not to be ad-
miniftered; becaufe, in the fame manner as the defendant is not made
refponfible by an acknowledgment, fo neither is he by a refufal to
fwear, and hence the tendering of an oath is ufelefs.
