relation, [Mohrim,] as here ufed, is to be under flood any perfon between
whom and the beholder marriage is utterly and perpetually illegal,
in confequence of affinity by either blood or marriage.):
E v e r y part in a relation which it is lawful to look at may like-
wife be touched; unlefs, however, there be a dread of its enflaming
the paffion of either, in which cafe neither the fight nor the touch is
approved.
T here is no impropriety in a man fitting in private with his female
relation, Or travelling with h e r; becaufe the prophet has faid,
“ No woman fh a ll travel more than three days and three nights, unlefs
“ accompanied by her hufband, or her relation; and if, in this ktife, the
“ woman Jhould have occafion to mount upon, or defend from, a horfe,
“ the man may then, in afffing her, without blame, touch her back or
“ belly, f covered, and provided he'be fir e o f his pafion\ but otherwife
“ he mujt beware <f touching her.' , •
E v er y part which it is lawful for a man to look at in his female
relation, pi ay likewife be viewed by him in the female Have o f another,
whether fhe be an abfolute Have, a Modetbbira, a Makdtibh, or
an Am-Waiid; for as a Have is neceffitated to wear clothes adapted to
fervife employments, that fhe may difcharge the bufinefs of her
mafter, and attend upon his guefts, her condition without the houfe
is therefore the fame, in relation to a flranger, as that o f a. free woman
without the houfe, in regard to her kinfman.— With refpedt to
privacy, or travelling with the female Have of another, many have
faid that it is allowed, in the fame manner as in the cafe of a female
relation.— Some, however, declare it improper, as not being juftified
by neceffity. Mohammed, in the Mabfoot, has faid, that the affifting
of a female to afcend or defcend from a horfe is approved, provided it
he in a cafe of neceffity.
It is permitted to a man to touch a female flave when he has an a“acb aJeaIib
inclination to buy her, notwithftanding he may be apprehenfive of with a view
lull. It is fo related in the abridgment of Kadooree; and Mohammed,
in the Jama Sagheer, has given a fimilar abfolute opinion in this cafe,
without making any exceptions as to the circumftance of luft. T h e
two difciples, on the other hand, maintain that although, on account
of neceffity, it be proper for a perfon to look at a Have girl when he is
about to purchafe her, notwithflanding it may be the means of inflaming
his paffion, ftill it is improper to touch her when under the
impulfe of paffion, or where there is a probability o f its being excited.
In cafe of an exemption from paffion, however, they hold it allowable
either to touch or look at her.

her in drawers only \ on the contrary, it is recjuiiite that lhe have two muft be put
clothes, in order that her back and belly may be covered, as thefe, baba* cent
with regard to her, may be confidered as privy parts. It is moreover
reported, {mm Mohammed, that when a female flavfc reaches the ag.e
of puberty, fhe muft not be expofed in drawers only, as that may
occafion luft.

man, whence any thing prohibited to a man is lo likewiie to him, ditearethe
for he poffefles virility, and is not difabled from copulation; and the
fame, alfo,. of a Majboob, or, complete eunuch; for he is likewife to thofe rules,
capable of friftion, and has the power o f paffing femen; and fo likewife
of an hermaphrodite, as he is merely a defective man.
I t is not lawful for a male flave to view his miftrefs, except in the A “ a,e % e

face, or palm of the hands, in the fame manner as a ftranger’ s. Mdlik his miftrefs
maintains that a flave is in the predicament of a kinfman within the fa“ e“or e
prohibited degrees; (and fuch alfo is the opinion of Shafei ;) becaufe hands,
his miftrefs is fubjedt to his entering her apartment frequently with-
